Terms of Service

These Terms of Service (“Terms”) govern your access to and use of dazcomm.com (the “Site”) and the services described on it, which are provided by Daz Communications (“Daz Communications,” “we,” “us”).

What we do

Daz Communications is an independent technology advisor. We help businesses compare, choose and buy services such as business internet, phone systems, POTS line replacement, managed IT and cybersecurity from many providers. We are not a telecommunications carrier, internet service provider or equipment manufacturer. Providers deliver, install, bill and support their own services under their own agreements with you.

How we are paid

Our advice and comparisons are generally provided at no charge to you. We are typically paid by providers, such as commissions or referral fees, when a customer we help buys their services. If we ever charge you a fee, we will tell you before you agree to it. Our goal is to recommend what fits your business, and you are always free to compare, ask questions and decide for yourself.

Quotes, pricing and information

Information on the Site and in any comparison we prepare is for general information and planning. It is not an offer, and it is not a guarantee of availability, price, speed, savings or performance. Availability, pricing, installation timelines, taxes, fees and credit approval are set by the provider and may change. Your agreement with a provider, not our comparison, controls the final terms, so please read it before you sign. Example comparisons on the Site are illustrations only.

Who may use the Site

The Site and our services are intended for businesses and for adults who are at least 18 years old. If you submit a request for a business, you confirm that you have authority to do so and that the information you provide is accurate and complete.

Contacting you

When you submit a request or give us your contact details, you agree that we may contact you by phone call and email about your request, including to follow up, schedule time with you and send information you asked for. Using the Site does not sign you up for text messages. Text messages are sent only if you separately opt in, as described below.

Text messaging

If you choose to receive text messages from us, our Text Messaging Terms apply, and they form part of these Terms. Agreeing to receive text messages is optional and is not a condition of buying anything from us or from any provider. Messaging frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help.

Acceptable use

You agree not to:

• use the Site for any unlawful, harmful, fraudulent or misleading purpose;
• submit false information or information about someone else without permission;
• use bots, scripts or other automated means to submit forms or collect content from the Site;
• interfere with or disrupt the Site, its security or its servers, or try to gain unauthorized access; or
• copy, resell or reuse Site content except as these Terms allow.

Our content and trademarks

The Site, including its text, design, logos and graphics, belongs to Daz Communications or our licensors and is protected by intellectual property laws. You may view and print pages for your own business use. Provider names, logos and trademarks belong to their owners. We use them only to identify providers, and their appearance on the Site does not mean the provider endorses us or that we endorse them.

Third-party websites and providers

The Site may link to websites and services run by others. We do not control them and are not responsible for their content, products, services or policies. Your dealings with providers and other third parties are between you and them.

Disclaimers

The Site and the information on it are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that any information from providers is complete or current.

Limitation of liability

To the fullest extent the law allows, Daz Communications and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising out of or related to your use of the Site or our services, even if we have been told such damages are possible. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Some places do not allow certain limits, so parts of this section may not apply to you.

Indemnification

You agree to defend and hold harmless Daz Communications and its owners, employees and contractors from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third party’s rights.

Changes to the Site and these Terms

We may change or discontinue any part of the Site at any time, and we may update these Terms. The “Last updated” date at the top of this page shows when they last changed. Your continued use of the Site after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of law rules. Any dispute relating to these Terms or the Site will be brought in the state or federal courts located in Missouri, and you consent to their jurisdiction.

General

These Terms, together with the Privacy Policy and Text Messaging Terms, are the entire agreement between you and us about the Site. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms. We may do so in connection with a sale or reorganization of our business.
